Deputy Police Commissioner Shadrack Sibiya
A high-stakes battle of wills was unfolding between Deputy Police Commissioner Shadrack Sibiya and Police Commissioner General Fannie Masemola. Sibiya's attorneys, Inan Levitt Attorneys, had delivered an ultimatum to Masemola, demanding that he reinstate Sibiya by Friday at 10 am or face court action.
The letter accused Masemola of acting unlawfully by pressing ahead with a fresh suspension process, which Sibiya's lawyers claimed was an abuse of power. They argued that Masemola's actions conceded the South African Police Service's procedural failings and constituted "mala fides and/or constructive contempt."
Sibiya demanded immediate steps, including the withdrawal of the new notice, the withdrawal of Masemola's current opposition to Sibiya's application, payment of the applicant's costs, and consent to the relief sought. If Masemola didn't comply, Sibiya's attorneys would seek further court orders, including a personal and punitive costs order.
This dispute was the latest chapter in a long-running saga. Sibiya had already approached the Gauteng High Court, alleging procedural breaches in the suspension process. Masemola's response had further fueled the fire, leading to this latest showdown.
As the clock ticked down to Friday's deadline, the tension was palpable. Would Masemola back down, or would the conflict escalate further, potentially destabilizing the South African police force? One thing was certain: Shadrack Sibiya was ready for battle.
The outcome of this high-stakes showdown would have far-reaching implications for the SAPS and the country's law enforcement. Would Sibiya emerge victorious, or would Masemola's opposition prove too strong? Only time would tell.
